1. Purpose and Scope

  • Governs use of the Pet.ug Marketplace by any seller, breeder, vendor, or service provider (“Seller”).
  • Forms part of the overall Terms of Service and is legally binding.
  • Outlines rules for listings, welfare compliance, payment, and accountability.

2. Eligibility & Verification

  • You must be at least 18 years old and a legal resident or registered entity in Uganda (or approved region).
  • Be the lawful owner or authorized agent of each animal listed.
  • Sellers engaged in commercial breeding or frequent sales must hold a valid breeder licence or business registration.
  • Provide tax identification number (TIN) and address.
  • Pet.ug may request KYC documents and veterinary certificates before enabling selling privileges.

3. Seller Responsibilities

  • Maintain accurate and complete listings with species, breed, sex, age, microchip, and health status.
  • Use current photos taken within 30 days and disclose all known defects or conditions.
  • Keep breeding and transfer records for at least 24 months.
  • Respond to buyer inquiries promptly and professionally.
  • Deliver as described and issue a bill of sale or adoption certificate at handover.

4. Animal Welfare & Legal Compliance

  • Comply with the Animal Prevention of Cruelty Acts (Uganda) and all welfare regulations.
  • Follow the Data Protection and Privacy Act (2019) for handling pet and buyer data.
  • Adhere to CITES for restricted animals and regional transport laws.
  • No listing of animals under 8 weeks unless lawfully permitted.
  • Ensure humane housing, feeding, and transport of all animals.
  • Immediately withdraw any sick, injured, or unfit animals from sale.

5. Prohibited Listings

  • Endangered or CITES-listed species without valid permits.
  • Wild-caught animals without legal capture licences.
  • Animals below the minimum legal sale age.
  • Stolen or illegally acquired animals.
  • Species prohibited by Ugandan or destination law.
  • Listings violating the Pet.ug Community Standards (Document #6).

6. Listings & Content Ownership

  • You retain ownership of your uploaded content.
  • You grant Pet.ug a worldwide, royalty-free licence to display and promote your listings.
  • Your content must not infringe third-party rights or contain false claims.
  • Pet.ug may edit or remove content that violates policy or law.

7. Payments, Fees & Payouts

  • Comply with Pet.ug’s fee and commission structure as published.
  • Buyers pay via approved processors; funds held in escrow until delivery confirmation or expiry.
  • Pet.ug deducts commission and fees before payout.
  • Payouts go to registered accounts or mobile money numbers.
  • Refunds and chargebacks follow the Refund & Escrow Policy (Document #5).

8. Disputes with Buyers

  • All disputes must first be reported via Pet.ug’s Resolution Center.
  • Sellers must respond within 48 hours.
  • Pet.ug may mediate and issue a binding decision after reviewing evidence.
  • Repeated non-cooperation may lead to suspension or delisting.

9. Tax & Record Keeping

  • Sellers are responsible for tax compliance (VAT, income tax).
  • Pet.ug may share transaction summaries with tax authorities if legally required.
  • Maintain sales and veterinary records for audit purposes.

10. Account Suspension & Termination

  • Pet.ug may suspend or terminate your account for policy breaches or legal violations.
  • Fraud, cruelty, or repeated buyer complaints can trigger account action.
  • During suspension, payouts may be held until investigation is resolved.

11. Liability and Indemnity

  • Pet.ug is not liable for any injury, loss, or damage from your listings or animals.
  • You indemnify Pet.ug and its affiliates from claims arising from false listings, legal breaches, or misuse of data.
  • Pet.ug’s total liability is limited to the fees paid in the past 12 months.

12. Confidentiality & Data Protection

  • Handle all buyer and pet data confidentially.
  • No external marketing use of buyer information without explicit consent.
  • Compliance with DPPA 2019 and Pet.ug Privacy Policy is mandatory.
  • Breach of confidentiality may lead to legal action and termination.

13. Intellectual Property and Brand Use

  • The Pet.ug name, logo, and platform remain our exclusive property.
  • You may use the Pet.ug brand only for approved marketing purposes.
  • Unauthorized representation or misuse is prohibited.

14. Force Majeure

Pet.ug is not responsible for delays or failures caused by circumstances beyond its control, including natural disasters, system outages, pandemics, or regulatory restrictions.


15. Governing Law & Jurisdiction

  • Governed by the laws of Uganda.
  • Disputes subject to exclusive jurisdiction of the courts of Kampala.
  • All parties must first attempt mediation through Pet.ug.

16. Amendments

  • Pet.ug may update this Agreement periodically.
  • Sellers will be notified of material changes via dashboard or email.
  • Continued use after notice means acceptance of new terms.

17. Acceptance

By listing an item or pet on Pet.ug, you acknowledge that you have read and accepted this Seller & Marketplace Agreement, the Privacy Policy, and the Terms of Service.
